Broadside, 8" x 10", printed on blue paper in different typesettings, blanks completed in manuscript. Two horizontal folds with light wear at either end, light tanning at edges and along folds. Signed in ink by Sidney Fairbank. At bottom of return is a chart showing a total of 53 returning officers. Very Good. The Return was evidently issued as an aspect of military activities related to the Mexican War. Sidney Fairbank, born in Harvard in 1819, was a carpenter and a manufacturer of wooden wares. He resided in Winchendon and was in partnership with Capt. E. Murdock for many years under the name Murdock & Fairbank. In 1851 Fairbank was chosen an officer of the newly formed Engine Company at Winchendon. In 1864 the Winchendon National Bank was started and Fairbank served on the first Board of Directors. Hardcover. Small 4to. Original blind-embossed brown cloth with gilt lettering and pictorial stamping, black cloth tape spine. 46pp. Good only. Boards edgeworn, though front board gilt strong and bright; modern library cloth tape spine rather homespun; inner hinges delicate but holding; small hand-lettered paper shelf label at lower left of front board. Decently tight and handleable copy of this state's militia laws on the eve of the Civil War. Ownership signature (in ink) on title page and same on front pastedown (in pencil) of Major T.D.L. Perkins, who twice adds "Commander of / Co. D 2d Regt Infantry / Roxbury City Guards / Jan 1st 1860." The Second Massachusetts Infantry Regiment was apparently formed around the date of Perkins' inscription, although sources usually cite the mustering in date of 18 May 1861, after which the inductees trained in West Roxbury on what was the site of Brook Farm (the famed Transcendentalist utopian community). Little is known about Major Perkins except that by May 26, 1861, when the regiment was activated, he had been transferred to commander of Company C of the First Massachusetts Infantry Regiment. Mild ex-library, the only mark being the 19th century front pastedown bookplate of the Carnegie-Stout Free Library of Dubuque, Iowa, with small hand-lettered plate below noting it was a gift from the Daughters of the American Revolution.

First Edition
First edition. 1 sheet ([1] p.). Folio. 35 x 21 cm. An important broadside noting the deficiencies of the volunteer militia. One of two states, this with the fourth line in bold-type. Opens: Commonwealth of Massachusetts. General orders. Head-quarters, Boston, June 17th, 1815. : On the 15th inst. the following order of Council was passed, viz.: "In Council, June 15th, 1815. The committee of Council to whom was referred a resolve of the legislature . respectfully report--that His Excellency be advised to issue his order for the discharge of all the volunteer corps raised for the defence of the commonwealth .":--By virtue, therefore, of the powers vested in him, His Excellency the commander in chief hereby discharges from further service, all the volunteer corps ." Brooks of course began by (1) thanking the men for "the generous, patriotic and voluntary tender of services for the defence of the Commonwealth, at the most threatening period of the late war, and the assiduity and zeal displayed by those Corps, in training themselves for usefulness in the field, without expense to the State." (2) discharge [them] from further service", and (3) ordering "all officers and others, who may have received from the Commonwealth ordnance, arms, or munitions of war of any kind, for the use, or on account of any of those Corps, to cause the same to be forthwith returned to the Quarter Master General, at Boston." But more importantly he used the occasion to make military revisions for the future, noting that "inconveniencies have arisen from restriction the election of company officers to the Wards," which he ordered changed and that "great irregularities" have followed "from the liberty that officers have taken to absent themselves for more than twelve months without leave from their Major Generals, and the still more numerous evils resulting from officers removing their places of residence to such a distance from the bounds of their respective commands, as to render discharge of their duty highly inconvenient, and sometimes, impossible." He ends by ordering wholesale changes in command structure. John Brooks (1752 -1825), a doctor by training, a Federalist by disposition, served under George Washington during the Revolutionary War, later helped to put down Shay's Rebellion, and at the conclusion of the War of 1812, was elected governor of Massachusetts less than a year after issuing this broadside. Rare. OCLC shows only two locations: American Antiquarian Society (which has both issues) and the Peabody Essex Museum, which has one. Not in American Imprints. A very good copy, old folds, some minor marginal browning and soiling.

The copy at the American Antiquarian Society is printed on half a sheet, with a similar broadside (intended to be separated).
