Francis Dunham Wormuth (1909-1980) was an American lawyer, having been a Distinguished Professor at University of Utah. Edwin Firmage, an international and constitutional law scholar, and professor emeritus of The University of Utah S.J. Quinney College of Law in Salt Lake City. A Hinckley Fellow at Brigham Young University, he graduated with high honors in political science and history. He received a master's degree in history from Brigham Young University. He was National Honors Scholar at the University of Chicago Law School and served on the editorial board of the Chicago Law Review. He received the doctor of law, master of laws, and doctor of jurisprudence degrees from Chicago, A careful, comprehensive, sharply focused, and biting scholarly review of the congressional and executive use of the War Powers. In this study, the authors examine the hotly debated question of where to assign the power to initiate and to conduct war, an issue that was also debated thoroughly during the writing of the Constitution. The authors content that the resulting Constitution assigned the power to initiate war solely to Congress, clearly separating the power to conduct war from the power to initiate it. Nevertheless, from the beginning of the Republic through the Vietnam War, presidents have committed acts of war without proper congressional authorizations. While factually examining essentially all of these presidential acts of war, the authors delve further into the legal questions of ratification by appropriation, delegation of the power to make war, the nature of "conditional war", and separation of powers in foreign relations.
