The 1840 convention sought to settle claims on both sides, many of which were likely the result of the Texas Independence movement. A joint American-Mexican commission was established to work out the claims, with any unresolved issues being sent to the King of Prussia for arbitration. This treaty marks a major step in the development of U.S.-Mexican relations before the Mexican-American War. It deals with the claims of U.S. citizens on Mexico, which were such a major cause of the war, and follows up the treaty of 1838 on that subject. The most important changes in this treaty were that the awards to claimants were to be paid one half in cash and the other half in treasury notes bearing eight percent annual interest and receivable for customs duties. "It must not be inferred that among the claims there was not a considerable number found on justice and equity, but not all of these were proper topics for national controversy. Had the United States government confined itself to these, and preferred its demands in a temperate manner, its course would have been in order, and Mexico could not rightly have refused their proper adjustment" - Bancroft, HISTORY OF MEXICO. This document reprints the 1828 "treaty of limits" between the United States and Mexico which set the U.S.-Mexico border along the Sabine River and which was the first treaty between those two nations. This printing also includes an additional article, negotiated in 1831, extending the time allowed for ratification of the 1828 treaty. The treaty was ratified in 1832. STREETER TEXAS 1103B. Withal, still very good. The official, folio, printing of this treaty. Such printings were done in small numbers. This treaty called for arbitration in the outstanding Mexican and U.S. claims. According to Bancroft, "The treaty of arbitration was a thorn in the flesh of many who had cast an evil eye on Mexico, as it did away with all pretexts for complaint against the latter Republic, and postponed indefinitely the acquisition of Texas." Not for long, as it turned out. This was the sixth, and last, Mexican treaty with the U.S. before war came after the annexation of Texas.
