The exceedingly useful and valuable series of documents preserved at the Public Record Office known as Feet of Fines (abstracts of which, as far as relate to Dorset, are printed in this volume), cover an unbroken period of over six centuries, that is to say, from the reign of Richard I. (a.d. 1196) to 4 William IV. In which year a Statute was passed for the abolition of Fines and Recoveries, and the substitution of more simple modes of assurance.
As Fines, or, as they are also called, Final Concords, were one of the most usual methods for assuring the transfer of lands and tenements from one party to another, it is desirable to explain with some degree of detail their meaning and manner of working.
Quoting largely from the well-known authority on legal matters, Blackstone, a Fine is described by him as being: An amiable composition or agreement of a suit either actual or fictitious by leave of the King or his Justices, whereby the lands in question become, or were acknowledged to be the right of one of the parties to the suit. Originally it was founded on an actual suit commenced at law for the recovery of the possession of lands or other hereditaments, and the possession thus gained by such composition was found to be so sure and effectual that fictitious actions were continued (until the system was abolished), for the sake of obtaining the same security.
